LIABILITY AND RELEASE WAIVER Lucky’s Pet Grooming Service Contract and Hold Harmless Liability Waiver 

THIS CONTRACT LIMITS OUR LIABILITY—PLEASE READ IT

INDEMNITY AGREEMENT AND RELEASE OF ALL LIABILITY

FOR USE OF LUCKY’S PET GROOMING SERVICES

As the owner or legal caretaker (“Dog Owner) of the below-referenced dog (“Owner’s Dog” or “my dog”) I have read, understand and agree to the following:

Terms and Conditions

Lucky’s pet grooming. (“Dog groomer”) and its employees, partners, agents, affiliates, and assigns, will exercise the utmost of due care to protect the health and safety of my dog while using the services associated with Lucky's pet grooming (“Services”).  In consideration of the Services and as an express condition thereof, I hereby waive and release, on behalf of myself, and my heirs, personal representatives and assigns, to the fullest extent permitted by law, any and all claims, and suits, including those relating to damage, illness, injury, death and/or escape,  against Lucky’s pet grooming and  Lucky’s pet grooming’s employees, partners, agents, affiliates, and assigns,  (collectively, the “Released Parties”) arising out of my dog’s use of the Services. I further agree to indemnify, defend, and hold Lucky’s pet grooming harmless against any claims by persons or entities other than myself related to my dog’s participation in the Services.

By enrolling my dog in the Services, I warrant and represent that I am the legal owner or caretaker of my dog and assume all risks, dangers and responsibility for injuries to my dog. I understand and agree that I am solely responsible for any harm to my dog while my dog is utilizing the Services. I understand and agree that I am solely responsible for any harm or damage caused by my dog while utilizing the Services. I agree to notify Lucky’s pet grooming of any and all alleged problems within twenty-four (24) hours of my dog’s use of the Services. 

I understand that before my dog can utilize the Services, all paperwork must be provided to a Lucky’s pet grooming agent, including, but not limited to: Service Contract and Client Information Form. 

Health of Dog

I understand and agree that my dog is in good health and has not been ill with any communicable disease or parasites within the last thirty (30) days. I agree that my dog will at all times be current on its vaccinations.

I agree that my dog does not have any condition that could potentially jeopardize the health of other dogs and/or people.

I understand that even with vaccinations, illnesses in dogs may occur.  Particularly, I understand that even if my dog is vaccinated for Bordetella (commonly known as Kennel Cough) there is a chance that my dog can still contract Kennel Cough. I agree that Lucky’s pet grooming  will not be responsible if my dog becomes ill, including if my dog contracts Kennel Cough.   

Lucky’s pet grooming requires that all dogs must:

·       Be current on rabies, distemper, adenovirus, parainfluenza, parvovirus and Bordetella vaccinations;

·       Be at least 6 months of age;

·       Be in general good health;

·       Be free of ticks and fleas;

·       Be leashed when entering and exiting grooming establishment; and

·       Have absolutely no history of aggression with other dogs and/or people.

I understand that Lucky’s pet grooming will not be held liable for a pre-existing condition of my dog or an accident caused by a pre-existing condition. 

I understand that Lucky’s pet grooming may, in its sole discretion and at any time, request proof of the above requirements, including but not limited to copies of vaccination certificates. I further understand that failure to abide by these requirements or comply with Lucky’s pet grooming ’s requests for documentation will result in immediate refusal of access to the doghouses and a ban on all future use of the Services. 

Cases of Matting

I acknowledge that my dog may have pre-existing health conditions as a result of a matted coat, which can include skin infection, fungus, bacteria, irritation, or other skin related issues. I acknowledge that removing a matted coat can result in nicks, cuts, abrasions, irritation, or bruising as a result of removing the matted coat from my dog due to warts, molds, and skin folds trapped or hidden in the matted coat. 

Lucky’s pet grooming is not responsible for any pre-existing conditions due to a matted coat. 

Termination of Services

I acknowledge the fact that in the event of my dog’s aggression, which can include but is not limited to, growling, biting, and scratching, the services rendered by Lucky’s pet grooming will cease immediately and the dog owner will be contacted. 

In cases of severe matting, Lucky’s pet grooming reserves the right to end the service. 

In the event of discovery of flea infestations Lucky’s pet grooming will cease service and contact dog owner. 

For all cases of termination of services the dog owner will be responsible for paying for services completed. 

Emergencies

 Due to the nature of the services rendered, the dog owner acknowledges the use of sharp tools and loud equipment entailed within the services. Dog owner recognize that there is a risk of injury to the owner’s dog during services. 

Lucky’s pet grooming  is authorized to seek veterinary assistance in the event of an emergency. I grant Lucky’s pet grooming  permission to take any and all steps necessary to obtain medical treatment for my dog and assume full responsibility for any and all charges incurred therewith, including but not limited to diagnosis, treatment, grooming, medical supplies and boarding. I understand that service at my dog’s veterinarian may not be feasible in the event of illness or injury and further consent to any professional veterinarian being retained to render care for my dog.

I understand that, in the event of an emergency, Lucky’s pet grooming  will make reasonable efforts to ensure the safety of my dog which may include removing them from the grooming location and contact me and/or my designated emergency contact regarding any treatment, illness, injury or potential problems as soon as the condition is deemed non-life threatening and/or contact is possible. 

Personal Property

I understand that Lucky’s pet grooming  is not liable for any lost, stolen or damaged personal property belonging either to me or to my dog. I further understand that if my dog causes any property damage to the doghouses, I assume all responsibility for the full cost of all treatment, repairs and replacements.

Fees

I understand that pricing may change for the following reasons including but not limited to,the state of my dog (age, weight, state of fur etc.), over staying the time limit as mentioned below, or yearly price changes. 

I agree to the fees and charges associated with the use of the Services and agree to pay for all charges immediately after I pick up my dog from Lucky's pet grooming  location.

Time Limit, Abandonment

I understand that due to the state of my dog’s coat and other behavioral issues, including but not limited to aggression, fear, or stress, services rendered by Lucky’s pet grooming may take longer than expected or stated. I acknowledge that for senior dogs, overweight dogs, and matted dogs, and other more time will be taken to ensure proper care and safety and allow my dog to stay as long as needed for services provided to the discretion of Lucky’s pet grooming. 

Agents of Lucky’s pet grooming will be responsible for notifying me when services have ended and for my dog’s pick up. 

I understand and agree that if my dog is not picked up by the end of the Lucky’s pet grooming  regular business day (if set business hours are being kept) or within the stated time limits (30 minutes per session), then I hereby expressly authorize Lucky’s pet grooming  to take whatever action is deemed necessary for the continuing care of my dog, including, but not limited to, doggie daycare and animal boarding. I agree to pay Lucky’s pet grooming  any and all costs of continuing such care immediately upon retrieval of my dog and understand that fees for such services rendered may vary depending on animal size.

I understand that if my dog is left for more than the maximum time allowed (30 minutes per session) , I will pay $5 per minute for every minute over the stated time limits until such time as the dog is retrieved from the doghouse by a Lucky’s pet grooming  representative or myself. If continuing care action is required, an administrative fee of $200 will be incurred in addition to the cost of the continuing care.

Further, I understand that if I do not pick up my dog within two (2) days from the boarding location, Lucky’s pet grooming  shall be authorized to proceed according to the local municipal code governing abandonment of animals and the authorities will be notified.

Photos and Videos

Occasionally, photos or video footage may be taken of dogs utilizing the Services. I agree to allow Lucky’s pet grooming  to use any image, video or likeness of my dog taken while using the Services for marketing, educational or promotional materials, understanding that the resulting photos, videos or likenesses are the sole property of Lucky’s pet grooming . 

Admittance

Lucky’s pet grooming  reserves the right to refuse admittance to any dog or to dismiss any dog that does not meet Lucky’s pet grooming ’s health, temperament or other standards. This determination shall be made at the sole discretion of Lucky’s pet grooming .

Lucky’s pet grooming  is committed to the safety and care of dogs and will promptly notify the authorities of any signs of neglect and/or abandonment. 

I understand and expressly agree that each and every of the foregoing provisions shall be in full force and effect and shall apply to each and every occasion on which my dog uses the Services. This Agreement shall remain in full force and effect as between the parties until and unless otherwise cancelled or superseded by written documentation signed by the parties.

I HAVE READ THIS AGREEMENT AND UNDERSTAND THAT IT IS AN AGREEMENT TO INDEMNIFY Lucky’s pet grooming  AND THE OTHER RELEASED PARTIES AND IT IS A WAIVER AND RELEASE OF LIABILITY AND A PROMISE NOT TO SUE OR MAKE A CLAIM.  I AM AWARE THAT THIS AGREEMENT IS A CONTRACT BETWEEN Lucky’s pet grooming  AND ME, AND THAT I CANNOT PARTICIPATE IN THE Lucky’s pet grooming  SERVICES UNLESS I SIGN THIS AGREEMENT, WHICH I AM DOING OF MY OWN FREE WILL.
